PKR MPs TOLD NOT TO LEAVE MALAYSIA

A PKR member of parliament told Sin Chew Daily that Pakatan Rakyat MPs had been instructed not to leave the country within the next two weeks.

The PKR MP said he had received the instruction from party leadership that the party would table a provisional no-confidence motion in the Parliament against prime minister Datuk Seri Abdullah Ahmad Badawi over the next two weeks under a peaceful and constitutional framework, and that all Pakatan MPs had to stay within the country pending further instructions.

"We have received very huge support in the country. Barring any unforeseen circumstances, the existing government will be replaced soon."

According to PKR information, Pakatan Rakyat has reached an internal accord of reserving the PM and DPM posts for Malays once it took over the federal government, as the current political environment is not favourable for a Chinese or Indian to become the deputy prime minister.

"You will be very shocked, as PAS president Datuk Seri Hadi Awang will be the deputy prime minister."

"However, two important Cabinet portfolios, namely the home ministry and the international trade and industries ministry, will be reserved for the Chinese, and DAP's Lim Kit Siang is a perfect candidate."

PKR vice president cum MP for Gopeng Dr Lee Boon Chye refused to confirm whether the MPs were instructed not to leave the country over the next two weeks, confirming instead that Anwar had told them to be on standby for further instruction.

He felt that the period of time from now to the UMNO elections next March could be a crucial period for change of federal government. Sinchew

    BN=PBB= TAIB MAHMUD PEMBULI

DONT FORGET THE RAPE OF THE PENANS

The brief uproar over the alleged rape of Penan school girls in the national media has died down, while the white-wash campaign in the Sarawak media continues unabated.

Recently, Sarawak Police Commissioner Mohamad Salleh reportedly said that a four-man team under his supervision went to Baram to start investigations. He announced that the team would investigate an alleged rape in 1994. He said, "Although the incident took place 14 years ago, I want to assure the public that are will investigate without fear or favour".

I remember that old case well, as I was directly involved in having the police report lodged-at the central police station (CPS) in Kuching.

I was still the sole opposition MP from Sarawak then. I was pressed quite a few times by my then colleague the MP of Petaling Jaya Dr Kua Kia Soong to look into the allegation of rape of a 15-year-old Penan girl in Baram. He had heard about it from some Australian NGOs.

On returning to Kuching, I decided to send my personal assistant See Chee How to Baram and visit the Penans. The 2000-mile journey to and fro would take two weeks.I was already physically weakened by my diabetic conditions while Chee How was young, fit, and very well-trained.

When Chee How returned to Kuching, he confirmed that the local Penan communities did tell him the story of a 15-year-old girl raped by some security personnel, and a six-year-old boy had also died from a tear gas attack upon a blockade put up to resist logging operations.

Apparently, the Penans had made the long-trip downriver to Marudi and even Miri, trying to make police reports against the crimes committed on their children. But the policemen on duty in these places simply refused to accept their police report.

We then decided that perhaps it would be better to bring the Penans to Kuching to lodge the police report. I was a serving MP, and had a little clout with the police, the media, and government departments and agencies in the capital city of Sarawak.

It must have been a logistics nightmare, a huge financial burden, and a communication cul-de-sac across 1000 miles of the dense forest in Sarawak. But with the help a group of very supportive friends, Chee How pulled it off.

Many months of hard work and thorough preparation later, the Penans walked into my office in Kuching one bright morning, in a single file, as they are wont to do in the forests. They wore street clothes and looked rather smart, though I surmised that they could not have felt very comfortable in them.

There were 18 Penans in the party, including four tua kampong (village chiefs) village elders, women, and the rape victim whose identity was never revealed. They settled down on two rows of long benches and faced the excited crowd of reporters who had turned out in full force to attend the first press conference by some Penans in their lives. Even reporters from a TV station were there!

A reporter would ask a question in simple Malay, such as "How many Penans in your area have been affected adversely by the logging?"

Apparently, the idea of a single spokesperson was (and probably still is) alien to the Penan culture. A Penan man would turn to his nearest neighbour and a brief consultation in their Penan language would ensure in a soft murmur.

That neighbour would turn to his nearest neighbour in turn, for a soft conference lasting a minute or two. The process would continue down the line until it returned to the first Penan who initiated the process. He would then give an exact number of Penans affected by bad logging in his area.

Despite the reporters impatience for quick, shot-gun responses to which they were used, the Penans answered their every question with this languid laborious and amiable process of group consultation in low whisper!

Naturally, there was little press coverage of what the Penans said at the press conference the next day. The media organisations in Sarawak were all either owned directly or under the thumb of the elite group who control political power and the logging interests in the state.

    Perfect hosts, perfect guests

That evening, i invited all my visitors from the Upper Baram forest to my house for a meal. IAfter the meal, we sat around in a big circle on the cement floor and chatted, as was the fashion with friendly gatherings among fellow Sarawakians. A good time was had by all.

Bright and early next morning, we proceeded as a single group to the Kuching central police station looking out to the Central Padang, where the Merdeka celebration is held annually.

I had made an appointment with the commanding officer at the CPS, and he was prepared. We were invited to sit round a large oblong table in a conference room. We had prepared a long report of the rape of the 15-year-old girl and the untimely death of the six-year-old boy at the blockade. While the long report was copied dutifully word for word into the brownish official police report book, the visitors from Baram were treated to coffee or tea, and cakes. The hosts were perfect hosts, and the guests were perfect guests.

During the remainder of the day, the Penan visitors made a few trips across town, trying to see officers in the Health, Education and other departments, and even the Chief Minister's office. It was no surprise to me that everywhere they went, the door was slammed shut in their face.

The transport and communication infrastructure in the vast remote rural area of Sarawak is so primitive that progress in working with the indigenous communities would take years where it would take mere weeks or months in the urban centres.

Unfortunately, my time ran out. In 1995, I was defeated in the parliamentary contest in Kuching. I was compelled to retire from politics because of my bad health.

(Fortunately, my friends in Sarawak continued to work hard in their lonely cause of defending the rights of the Sarawak indigenous communities. Chee How had since qualified as a lawyer and he joined Baru Bian's law firm. Between them, they now have over 100 cases in court, representing various indigenous communities all across Sarawak against encroachment upon their customary land rights by the state government, loggers, and plantation companies).

I tell this tale not for the self-serving purpose of showing how heroic I was in trying to bring justice for the Penans. I merely want to show how hard it is for the Penans just to make a police report if a Penan girl is raped, and a Penan boy, killed.

That is the sort of injustice that cries out for the total overhaul of our political culture. Surely, the greatness or meanness of our Malaysian society is judged by how the weakest members of our Malaysian body politics are treated by the institutions of power?

Since then, I have thought about that poor Penan girl often.

    Rapists are the real culprits

In my book of crime against humanity, rape is very near to the top of the list. I am not merely being self-righteous. I just have to think of the numerous beloved female members of my extended family.

I also agree with most women NGO's that rapes are not caused by women who are beautiful or who wear sexy clothes. Rapes are not crimes of sexual passion; they are crimes of violence. The rapists are the real criminals. They leave incurable and life-long psychological scars on their victims, who probably would never recover from their ordeal of being violated.

Chee How told me a few days ago that the Penan rape victim has since moved from Upper Baram to Middle Baram. She has never married nor led a normal family life. She should be 29 this year.

So now, the Sarawak police chief wants to pursue this case 14 long years later - "without fear or favour"? One can only be "cautiously optimistic" about such a declaration of intent, which is the same as saying that one is down right cynical about the outcome of the police investigation.

Meanwhile, in the last 14 years, how many Penan girls and women have been raped by outside parties in the remote hostile and god-forsaken forests of Sarawak? We will never know. Even making a police report on such a heinous crime is so difficult for the Penans!

I have been cautioned many times not to reveal the identity of any rape victim. I will just say that the initial for that poor Penan girl 14 years ago is "S", in case the police needs reminding.

I am very fond of her.

LEGAL, MORAL VICTORY FOR IBAN & NCR

Tony Thien:The Iban community of Sarawak recorded a major legal and moral victory when the High Court in Bintulu ruled in their favour in a case involving Native Customary Rights (NCR) to land.

The court yesterday upheld a magistrate’s decision to reject a criminal charge against 14 Iban from a longhouse in Bintulu Division Rumah Nor, for allegedly occupying state land illegally.

After hearing submissions by their lawyer Baru Bian and the deputy public prosecutor, judge Sunggau Gunting rejected the prosecution’s appeal against the lower court’s decision.

The judge said doubts had been raised as to whether the 14 had committed a criminal offence under Section 209 (1)(a) of the Land Code of Sarawak on May 20, 1998, when they allegedly occupied ‘without authority’ the state land within the proposed Bandar Samarakan township.

Baru Bian later told Malaysiakini that the High Court’s decision was not a surprise because NCR claims can extend to state land.

The group was charged in the Bintulu Magistrate’s Court on Feb 29, 2002. They claimed trial on grounds that they held NCR for the area where they had built farm huts. They said this was within their pemakai menua (territorial domain).

During the proceedings, their lawyer cited a related Court of Appeal judgment in the Nor Nyawai civil case. The respondent lost the case, but the court recognised that parts of the contested land was under NCR and therefore should be accorded to indigenous peoples.

The Nor Nyawai judgement reads: “The balance of 17,227 acres is not contested by the appellants (therefore should be considered) as being under native customary rights."

During the criminal trial, the 14 accused maintained that their huts were built within the stipulated area, although a prosecution witness had disputed their claim.

The testimony did not distinguish the NCR and non-NCR areas sufficiently for the magistrate, who then freed the accused without calling for their defence on May 25, 2006.

This led to the prosecution filing an appeal. However, after yesterday’s decision in the High Court, there has been no indication of a further appeal.

Since being freed, the 14 have sued the Sarawak government for malicious prosecution and for damages due to demolition of some of their huts.

According to their lawyer, the civil case is pending in the Bintulu Sessions Court and is expected to proceed soon.

Congratulation to Baru Bian, Sarawak PKR Member

PINJAMAN RM5 BILLION MERUGIKAN DANA AWAM

SIASAT NAJIB KES SMS ISU ALTANTUYA

Alfredo Jabb sekadar menumpang kasih, tetap menumpang sampai bila-bila. Apatah lagi Gojer Cann yang memerintah Miri, langsung kempunan.
Bila lagi awak nak mengundur diri Taibi? Rakyat kebanyakan muak dan loya mendengar alasanmu. Rakyat marhaen cuma mampu sumpah seranah mendoakan kependekan hayatmu. Berubahlah. Bertaubatlah.

PKR: BELUM BERMINAT TERUSKAN USUL UNDI TAK PERCAYA

Selain menggesa kerajaan mengemukakan semula belanjawan 2009, susulan krisis kewangan dunia sekarang, Anwar turut mencadangkan kerajaan menurunkan lagi harga minyak kerana harga dunia bahan bakar itu makin rendah

ANWAR MINTA NAJIB BENTANG BAGET BARU

    HINDRAF CABAR BUKTIKAN MEREKA BIADAP

LETTER FROM SHAARIIBUU, ALTANTUYA'S FATHER TO RAJA PETRA

I understand, Mr. Raja Petra has good personal character and has a good reputation and runs humanitarian activity.
I understand that the below issues were directly connected with murder case of my daughter:
    - Who did arrange visa issue for my daughter while she visited in French?
    - Who was attending in the trip to French and what did they do?

If it could make clear those issues, they would understand every thing. Why is there so much force and influence in the case? Because there was a serious issue. Thus they destroyed my daughter.

Unfortunately, they pressed down Mr.Raja Petra's statement. I think this issue needs to get attention from international human right organizations. He (RPK) shouldn't be a victim of politic for justice. It would be justice if they release Mr.Raja Petra.

As we are, all Mongolian worry for him and his justice, we lack of information on truth and situation.

    Pakatan considers no-confidence vote

    By Shannon Teoh
KUALA LUMPUR, Oct 8 - Pakatan Rakyat (PR) leaders met last night to discuss their options ahead of Datuk Seri Abdullah Badawi's expected decision on when he will step down as prime minister.

DAP Parliamentary leader Lim Kit Siang told The Malaysian Insider that the opposition coalition "had a meeting to discuss options on how to effect a no-confidence measure."

When pressed if this meant that something was lined up for when Parliament reconvenes on Oct 13, he replied: "Should be."

Also present at the meeting with opposition leader and de facto PKR chief Datuk Seri Anwar Ibrahim was Pas secretary-general Datuk Kamaruddin Jaafar, who also would not confirm that the next move in the coalition's takeover plans would occur in Dewan Rakyat.

"We did discuss our options to form the next government. The plan is still intact and ongoing but we expect Barisan Nasional to be prepared in Parliament," he said.

He revealed, however, that Abdullah's announcement as to whether he would be defending his post as Umno president - who by convention becomes BN chair and hence, prime minister - in March 2009 would be a factor in determining the final decision.

The opposition are understood to be keeping their cards close to their chest and will not make early announcements on their plans after their much-hyped Sept 16 takeover plans did not materialise.

After it had won an unprecedented 81 seats to BN's 140 in the March 8 general election, Anwar had declared that Pakatan Rakyat would topple the BN government on the symbolic date of Malaysia Day - which marks the formation of the country six years after gaining independence in 1957.

The former deputy prime minister still maintains that "we have the numbers" to gain the majority in Parliament.

Dialogue to clear air on ‘eviction’ tomorrow

KUCHING: A dialogue with the Kedayan-Malay villagers who claimed that they were made to evict their lands in Bekenu will be held in Miri tomorrow.

Assistant Minister of Land Development Mohd Naroden Majais, in revealing this, said that Chief Minister Pehin Sri Abdul Taib Mahmud would also be involved in the dialogue to clear the air surrounding the eviction of some 10,000 people from 13 villages in the area.

“At this point we are not sure of the status of the land in question - whether it is Native Customary Right (NCR) land or state land,” he told reporters at his Hari Raya Aidilfitri open house here last Saturday night.

He said that the Land and Survey Department was currently doing a thorough investigation on the affected area and to find out the real status of the land.

“The department needs to find out the status of the land first before further discussion can be held and for the villagers to apply for the land,” he said, adding that the government had no intention of taking away NCR land without proper discussion with the people.

“Like what the Chief Minister said, if the villagers feel that they have the rights on the land then they can appeal through the proper channel and everything can be resolved amicably,” he said.

Meanwhile, the director of Land and Survey Department, Sudarsono Osman, had clarified through a faxed statement last Saturday that the department had never issued any eviction order to the Kedayan-Malay villagers in Bekenu, refuting a recent report in a national daily.

He said the department had received copies of the eviction letter issued by advocates of a company to eight individuals warning them not to trespass on its land.

“They are not eviction letters from us as alleged,” he said when referring to Lot 3935 Lambir Land District and Lot 4448 Sibuti Land District.

He explained that the lots had been alienated and issued a provisional lease to a company on Feb 6, 2001 for the development of an oil palm plantation.

    From The Borneo Post Online

Let’s talk, but don’t try any rough stuff with me: CM

KUCHING: Chief Minister Pehin Sri Abdul Taib Mahmud said he is open to discussion on a supposed eviction of some 10,000 villagers from 13 Kedayan-Malay villages in Bekenu.

What discussion? Why only now? Does anyone think that this man is really open to discussion? Or he wants the people to come begging to him so that he can placate them with some devious promises not meant to be fulfilled?

He said although he had yet to hear from the affected villagers, he felt that the best way to resolve the matter was to come and see him and not try any rough stuff with him.

Why shouldn't the people play rough when this is the way they are treated, like illegal squatters and asked to get off their land and leave their houses just before Hari Raya? He has yet to hear? What rubbish! In the first place doesn't he know or are we to believe that he doesn't know?

“Because once you start playing rough, you cut all communication with me. In the end, you still have to communicate with me because I’m the government … whether or not the claim is good (only) then I can consider,” he told reporters at the second day of his Hari Raya Aidilfitri open house at Stadium Perpaduan here yesterday.

Why was there no communication with the affected villagers except for the notice of eviction? So the villagers who have been leaving there for the last 100 years now have to prove their claim? Surely they should have been considered even before any such decision was made? The arrogance of this man seems to know no bounds. Just because he "is the government" does that mean he can do what he likes and treat the people as he likes?

He stressed that there was no way of talking things through if one were to go about the situation in a rough manner.

This doesn't apply to him of course as he can be as rough as he wants to with the people. Try talking to him and see what happens - he will just talk them down roughly. We have seen this many times, and which is why even his ministers and the so-called peoples' representatives are scared shitless of him. What kind of leader is this?

“The government can work out something. If you want to make an appeal, make an appeal. That’s the best way. Tell the story properly,” he added.

Of course the government can work out something, but that is after the fact. Why should it be that the people have to appeal? Why were the interests of the affected villagers not even taken into consideration prior to their land being given to a private developer? WHO IS THIS PRIVATE DEVELOPER ANY WAY?

On Saturday, a group of people from the 13 villages protested a move to evict them from their century-old settlement by a private developer.

They allegedly received a notice on Sept 15 from the company’s lawyers to leave within 14 days.

For them to be so arrogant they must have someone powerful and even more arrogant, like Taib, behind them. Not even their elected representatives nor the idiot 2nd Minister of Resource Planning and Mismanagement knew what what was going on, if they are to be believed.

The affected villagers, as claimed by a group that protested peacefully at Kampung Beraya junction yesterday, are from the villages of Batu Satu, Butir, Kejapil, Keluru Tengah, Keluru Jaya, Subak, Sepurau, Selanyau, Opak, Tusan, Uban, Terahad and Beraya.

The villagers claimed that the area concerned was an old burial ground of their Kedayan Muslim ancestors and that the affected cemeteries are Kubur Islam Kejapil, Kubur Butir, Kubur Sungai Jalil, Uban and Kubur Sungai Payau.

The Kedayans settled in the area sometime in 1910.

Chief Minister & Sons Berhad & The Sarawak Dams: Taib family’s CMS to benefit from dam

Who will foot the bill for the resettlement of those affected by the new RM3 billion Murum dam?

    MCPX

”Is it Sarawak Energy (Berhad) or will it be passed on directly to the state government and hence the taxpayer,” asked one Sarawak-based activist, who declined to be identified.

In the case of Bakun, the mega-dam in central Sarawak which is still under construction, compensation to indigenous people and resettlement cost the Sarawak and federal governments over RM876 million.

sarawak dam project 050708 tutoh dam”But there are still Bakun residents who have not received compensation even though they left the Bakun area 10 years ago,” noted the auditor-general in his 2007 annual report.

Sarawak Energy Berhad (SEB), which is 65 percent owned by the Sarawak state government, will fund the Murum dam. It was reported in June that SEB would issue bonds to finance the project.

SEB has been in negotiations with infrastructure firm Cahaya Mata Sarawak (CMS) and the multinational Rio Tinto Alcan to supply 900-1,200MW of electricity to power a huge smelter. A power purchase agreement was supposed to have been signed by Aug 31, and there has been no news since.

Both CMS and Rio Tinto are in a consortium, the Sarawak Aluminium Company (Salco), to build the US$2 billion aluminium smelter with an initial annual capacity of 550,000 tonnes, which could later be expanded to 1.5 million tonnes. The smelter is located in the Similajau area of Sarawak, not far from the proposed Murum and Bakun dams.

Rio Tinto Alcan, which has a 60 percent stake in Salco, owns bauxite mines, alumina refineries and aluminium smelters around the world.

CMS, a listed infrastructure firm controlled by Sarawak Chief Minister Taib Mahmud’s family, is a major producer and supplier of steel, cement and other construction materials in the state. Taib (photo, far left) has been chief minister of Sarawak for more than 25 years.

According to the firm’s 2007 annual report, the substantial shareholders of CMS are the chief minister’s daughters, Jamilah Hamidah and Hanifah Hajar, son-in-law Syed Ahmad Alwee Alsree, and family concern Majaharta Sdn Bhd, each with a 14 percent stake.

Taib’s wife Lejla has an 11 percent stake while sons, Sulaiman Abdul Rahman and Mahmud Abu Bekir, own 9 percent each.

Taib’s brother-in-law, Aziz Husain, on the other hand, happens to be managing director of SEB.

Why the need of so many dams?

Sarawak plans to lure such energy-hungry industries by providing an abundant supply of cheap electricity within the 320-km long Sarawak Corridor of Renewable Energy (Score), an economic development region, managed by the state, where abundant power would be supplied to energy-intensive private industries.

Score, launched by Prime Minister Abdullah Ahmad Badawi in February 2008, aims to tap into the state’s 20,000MW hydropower potential by building even more dams in the longer term.

Sarawak’s current installed capacity is just 980MW, adequate for its current needs of about 750MW, but it aims to expand its hydro capacity to 7,000MW or more over the next decade by building a string of 12 dams (refer map) along the various rivers in the state.

hydropower projects in sarawak 2008 2020 murum

While smelters could create jobs and contribute to GDP, the funding for the dams required to supply cheap electricity will have to be raised by the state or borrowed from public pension funds (as in the case of Bakun).

And while indigenous ommunities are displaced, many foreign workers will have to be brought in for the construction of the dams. And then there are the environmental costs.

”Will that justify building Murum at a probable estimated cost of RM3 billion, with likely cost overruns to RM5 billion?” asked a Sarawak-based academic, who declined to be identified.

In the case of Bakun, ”cost over-runs of RM708 million were approved by the Finance Ministry even though the contract was for a fixed lump sum with all risks to be borne by the main contractor (a consortium of private Malaysian companies and China interests),” chided the auditor-general in his report.

Sarawak Hidro, the Bakun dam developer, has outstanding borrowings (as at end-2007) of RM3.4 billion. It had received RM3 billion from a state-managed workers’ pension fund, the Employees’ Provident Fund (EPF) in 2007, and RM400 million from a state-owned pension trust fund in 2002.

The EPF loan is guaranteed by the federal government. The federal government had also allocated RM1.8 billion for the project between 1997 and 2004. Sarawak Hidro has already spent RM4 billion on the project.

    Natives: Better bomb us now

    So is Murum really necessary?

”For energy needs in Sarawak, we don’t need the Murum, because Bakun is more than enough to supply the state’s needs,” says Raymond Abin of the Borneo Resource Institute (Brimas). ”Of course, (much of) this will not go to the really rural areas but will supply industry’s needs.”

“The impression among many sceptics is that these are all self-serving projects,” said another senior academic in a Sarawak-based university, carefully weighing his words while requesting anonymity.

All these funds are not helping the most affected communities like the Penan.

”This is not development for the Penan. This is not assisting the Penan,” says Weng, a Penan whose home will be submerged. ”This is killing the Penan. As our old headman said before, better bomb us now than ‘kill’ us slowly!”
