    DUN KOTA SIPUTEH DIISTIHARKAN KOSONG

    Kerusi DUN Kota Siputeh diisytiharkan kosong dan satu pilihan raya kecil seharusnya dipanggil untuk mengisi kekosongan tersebut.

    Keputusan tersebut dibuat oleh Mahkamah Tinggi Kuala Lumpur petang ini setelah mendengar permohonan Speaker DUN Kedah, Datuk Dr Abdul Isa Ismail untuk semakan kehakiman terhadap keputusan Suruhanjaya Pilihan Raya (SPR) yang mengekalkan Datuk Abu Hassan Sarif sebagai wakil rakyat di situ.

    Abdul Isa memfailkan saman pada 1 Oktober lalu, menamakan Abu Hassan daripada BN dan SPR sebagai responden.

    Beliau memohon diisytiharkan Abu Hassan bukan lagi ADUN bagi kerusi tersebut berikutan kegagalannya menghadiri dua persidangan DUN secara berturut-turut dan injunksi menghalang beliau daripada menjalankan tugas sebagai wakil rakyat.

    Beliau juga memohon mahkamah mengisytiharkan kerusi itu kosong dan memerintahkan SPR mengadakan pilihan raya kecil di samping memohon ganti rugi, kos dan faedah lain.

    Pada 1 September lalu, SPR memutuskan tidak berlaku kekosongan di kerusi Kota Siputeh dan Abu Hassan masih menjadi wakil rakyatnya.

    Peguam Kanan Persekutuan Suzana Atan bertindak bagi pihak SPR.

    Sementara itu, mahkamah menolak permohonan lisan pihak responden untuk menangguhkan pelaksanaan keputusan hari ini.

    Bagaimanapun, mahkamah menetapkan Jumaat untuk mendengar permohonan formal untuk menangguhkan keputusan mahkamah.- Dari Malaysiakini

    ANWAR BERI KATA DUA KEPADA PEMIMPIN KEADILAN

    Datuk Seri Anwar Ibrahim memberi kata dua kepada pemimpin dan anggota PKR sama ada setia atau keluar daripada parti jika tidak mahu mengikut dasar yang ditetapkan.

    "Semua anggota parti mestilah menyokong agenda perubahan, bekerja untuk Pakatan Rakyat atau terpaksa disingkirkan daripada parti," katanya.

    NONEAnwar yang juga ketua umum PKR menegaskan demikian ketika berucap merasmikan Konvensyen PKR Pulau Pinang malam tadi.

    Katanya, ramai pemimpin PKR yang mahu tindakan tegas dikenakan terhadap anggota yang tidak dapat mengikut dasar parti.

    "Beri komitmen kepada parti atau tinggalkan parti dan sertai Umno," katanya.

    Anwar yang juga ketua pembangkang berkata ketua cabang dan wakil rakyat PKR hendaklah sentiasa mematuhi dasar-dasar parti.

    Katanya, mereka tidak boleh beranggapan bahawa mereka akan terus menjadi pemimpin dan wakil rakyat untuk selama-lamanya.

    Sebaliknya, kata beliau, mereka mesti berkhidmat kepada rakyat dan mematuhi dasar dan prinsip-pembaharuan parti.

    Anwar berkata, walaupun sesetengah kritikan terhadap pemimpin dan wakil rakyat parti ti boleh diterima, tetapi menegaskan bahawa beliau tidak akan berkompromi dengan mereka yang enggan mematuhidasar-dasar yang ditetapkan oleh parti.- Malaysiakini.

    Police stand guard while Samling’s excavators plough through Kenyah’s NCR land

    BELAGA – A group of police officers are guarding the workers of Samling Plantation Sdn. Bhd. while clearing works are being carried out using excavators inside the native customary land territory of the Kenyahs from Long Koyan for the purpose of establishing an oil palm plantation.

    Samling started its clearing works yesterday, but were stopped and told to leave by the Kenyah villagers.

    Today however, Samling ignored the villagers and continued to plough through Kenyah’s native customary land under guard from the Royal Malaysian Police.

    The villagers are angry with Samling for not heeding their warnings not to encroach into their territory. But they are more disappointed with the actions of the police, who they say time and time again are not professional in their conduct and are visibly seen to be in collusion with the company.

    Prior to this, the village head of Long Koyan, TK Nyalang Tahe has made numerous police reports on Samling’s encroachments but no action was taken by the police. He even went to stop an excavator to confiscate its keys so that he could surrender it to the police for the police to take action against the company.

    However, on 21 July 2009, the police issued a warrant of arrest to TK Nyalang Tahe and he was summoned by the police to surrender himself to the Sungai Asap Police Station. Apparently, a police report was made by the company against TK Nyalang for allegedly stealing an excavator belonging to Samling.

    TK Nyalang and his residents argued with the police that the excavator was not stolen and it is still under the care of the workers of Samling Plantation. The keys are in their possession as it was passed to them by the plantation workers. They said it is even stated in their police report.

    The police than told TK Nyalang to sign a police bond and he has to appear at the Belaga Magistrate Court on 21 August 2009 to answer to the charge of stealing.

    TK Nyalang abided by the police order appeared at Belaga Magistrate Court on the morning of 21 August 2009. But he was shocked when told by the Court’s registry that the police have not even registered his case to be mentioned on that day.

    TK Nyalang went back to the Sungai Asap Police Station to seek clarification from the police, but the police told him that they will inform him when he is supposed to appear in court. However, until today the police have not informed him on the status of the case.

    Include Bidayuh, Iban in Federal Constitution- Riot

    Serian Member of Parliament Datuk Richard Riot wants Article 161A (6) and 161(7) of the Federal Constitution amended to include 'Bidayuh' and 'Iban'.

    "The word 'native' in the Sarawak context under Article 161A (6) means a person who is a citizen and either belongs to one of the races specified in Clause (7) as indigenous to the State or is of mixed blood deriving exclusively from both races.

    "Listed under Clause (6) are the indigenous people of Sarawak -Bukitans, Bisayahs, Dusuns, Sea Dayaks, Land Dayaks, Kadayans,Kalabits, Kayans, Kenyags (including Sabups and Sipengs), Kajangs(including Sekapans, Kejamans, Lahanans, Punans, Tanjoings and Kanowits), Lugats, Lisums, Malays, Melanos, Muruts, Penans, Sians,Tagals, Tabuns and Ukits," read Riot.

    He questioned the missing 'Bidayuh' and 'Iban' under the same clause.

    "Where are we? Where am I as a Bidayuh? Where is Kapit Member of Parliament (Alexander Linggi) as an Iban?" asked Riot in Parliament yesterday.

    He therefore wanted the name 'Bidayuh' and 'Iban' to be included in the Article for fear the two races might just "disappear from the surface of the earth".

    Riot brought up an example set by (Sarawak) State Legislative Assembly for making the necessary amendment by replacing the terms 'Land Dayak' with Bidayuh and 'Sea Dayak' with Iban.

    "The terms 'Land Dayak' and 'Sea Dayak' were used during the colonial era, and the State Government had made the necessary amendment in the Sarawak Constitution," said Riot.
    On the same debate, he narrated the case of not only Marina Undau's but also Lymee James', who was born to an Iban-Bidayuh father and a Chinese mother.

    He said that Lymee, like Marina, scored 9A 1B in SPM but his application for a matriculation programme was turned down because he was not considered a Bumiputera (native).

    "I am not a lawyer, but according to the law of domicility, if the father is a Chinese, the children will be Chinese. If the father is a Malay, the children will be Malay. If the father is Iban, the children will be Iban. If the father is a Bidayuh, the children will be Bidayuh," said Riot.- Eastern Times

    Pakatan finally applies to be formal coalition

    At last, Pakatan Rakyat (PR) has taken a big step towards formalising its alliance in order to go head on with Barisan Nasional (BN) as a registered coalition at the next general election.

    The Malaysian Insider understands that officials from the PR alliance handed in their application to be made a formal coalition to the Registrar of Societies (RoS) some time earlier this week.

    According to government sources, some 10 names each from DAP, PAS and PKR were listed in the registration form, together with a list of common objectives, which are expected to be laid out when the alliance holds its first convention next month.

    A logo bearing a “rising sun” was also tendered — signalling a “new dawn” for the country — as the fledgling opposition front’s symbol against BN’s dacing, or scale.

    The PR bloc believes its application this time will pass muster, based on the new stand taken by the Registrar of Societies Datuk Md Alias Kalil.

    Md Alias had publicly stated that the previous reading of Section 2 of the Societies Act 1966, which states any coalition of political parties must have at least seven political parties as members to be registered did not apply.

    The loose alliance of PKR, DAP and PAS first came together in the wake of the landmark March 8 general election last year, which saw its members wrest control of four key states from BN in spite of fundamental differences in philosophies.

    But it remains to be seen if PKR, PAS and DAP will be able to settle their various spats within their respective parties as well as with each other and present a force capable of challenging BN.

    The growing infighting within all three parties — from Sabah PKR leaders quitting in protest against heavy-handed treatment from its peninsula-based central leadership to frequent eruptions between the religious PAS and socialist DAP — has only served to diminish their viability in the eyes of the increasingly weary and wary public.

    PR will need to keep in mind that many of the votes cast were also an act of protest against BN for perceived arrogance.

    But under Datuk Seri Najib Razak, BN has managed to claw back some support for the ruling coalition.- Malaysian Insider
